The US Shield and the Erosion of Accountability: How Unconditional Support for Israel Undermines Global Human Rights and Entangles the US in Middle East Conflicts

The founding principles of the modern international legal system, with the International Court of Justice (ICJ) at its core, were built upon the ruins of World War II with a simple yet profound promise: never again. The goal was to establish a rules-based order where all nations, regardless of their size or power, would be held accountable for actions that violate international law, particularly those concerning human rights and self-determination. However, the consistent and unyielding support provided by the United States to Israel has increasingly created a gaping exception to this rule, directly undermining the efficacy and credibility of international law. This blind defense has not only allowed Israel to act with impunity but has also deepened the United States' own legal, ethical, economic, and military entanglements in the Middle East.
The US Vs. International Law: A Pattern of Obstruction
The United States' approach to international law when it comes to Israel is characterized by a "special relationship" that overrides international consensus. This is most evident in the US use of its veto power on the United Nations Security Council (UNSC). Over the decades, the US has blocked dozens of resolutions critical of Israel, including those condemning illegal settlements, excessive use of force against civilians, and calls for an independent Palestinian state.
This obstructionism is not limited to the UNSC. In 2021, when the International Criminal Court (ICC) announced its jurisdiction to investigate potential war crimes committed in the Palestinian territories by both Israeli forces and Palestinian groups, the US, under the Trump administration, issued harsh sanctions against ICC officials, including Prosecutor Fatou Bensouda. While the Biden administration lifted these direct sanctions, it has continued to "vigorously oppose" the ICC investigation, reinforcing the perception that the US believes its allies should be immune from international scrutiny. The US pressure campaign has included diplomatic lobbying against the ICC and has sent a clear message to the international community: international accountability mechanisms are acceptable only when they align with US strategic interests.
Israel's Shield: Impunity on the Ground
For Israel, this unconditional American support has served as a powerful shield against accountability. The Israeli government understands that no matter how egregious its actions—whether it be the relentless expansion of illegal settlements in the West Bank, the devastating and disproportional military assaults on the Gaza Strip, or the systematic mistreatment of Palestinian detainees—it will not face meaningful consequences on the world stage, primarily because the US will step in to block them.
This impunity creates a dangerous moral hazard. It emboldens right-wing elements within Israeli society and government to pursue policies that make a two-state solution increasingly impossible. The continued expansion of settlements, a direct violation of the Fourth Geneva Convention, has been carried out with the understanding that the US will not use its significant leverage (including $3.8 billion in annual military aid) to halt it. This has led to a cycle where Israeli human rights abuses go unchecked, fueling further violence and rendering the path to a peaceful resolution more elusive than ever.
The Economic and Military Costs for the United States
The US policy towards Israel is often framed as a "strategic asset," a democratic anchor in a volatile region. However, a closer examination reveals that this policy has significantly entangled the US economically and militarily, with costs that are increasingly difficult to justify.
Economically, the US provides substantial amounts of foreign aid to Israel, the vast majority of which is military assistance. From 1946 to 2023, the US has provided Israel with a cumulative $158.8 billion (not adjusted for inflation) in bilateral aid, making it the largest cumulative recipient of US foreign aid. This massive transfer of funds, particularly the Foreign Military Financing (FMF) grants that are almost entirely spent on American-made weapons, has sustained Israel's military superiority in the region. This aid package is formalized in ten-year memorandums of understanding, which lock in specific funding levels, making it exceptionally difficult to adjust based on changing circumstances or Israeli behavior. Critics point out that these funds could be redirected to domestic priorities or to humanitarian assistance that is more directly aligned with US national interests.
Militarily, the unyielding support for Israel has drawn the US into regional conflicts. The perception that the US is an biased actor, blindly supporting Israel, fuels anti-American sentiment across the Middle East. This anti-Americanism has been a key recruiting tool for terrorist organizations and has led to direct attacks on US military and diplomatic personnel. In Iraq and Syria, for example, US forces have frequently been targeted by militias aligned with Iran, which often cite US support for Israel as a justification for their attacks.
Furthermore, the US dedication to maintaining Israel's "Qualitative Military Edge" (QME) has sparked an arms race in the region. To reassure its Arab allies who are concerned about this unconditional support, the US often sells them advanced military hardware. This, in turn, prompts Israel to seek even more advanced technology from the US to maintain its edge. This dynamic not only increases regional instability but also places tremendous stress on US defense resources and planning.
The Erosion of Global Credibility and the Future
The consequences of this approach extend far beyond the Middle East. The US stance on Israel significantly damages its own credibility as a champion of democracy and human rights. When the US condemns human rights abuses in other countries, such as Russia's invasion of Ukraine, while simultaneously blocking efforts to hold Israel accountable for actions that international bodies and human rights organizations have repeatedly flagged, it opens itself to charges of hypocrisy. This perceived inconsistency undermines US diplomatic efforts on a wide range of global issues, from climate change to public health, and weakens its ability to lead.
The future of US policy towards Israel and Palestine is a subject of growing debate within the United States. A younger generation of Americans, as well as a growing number of policymakers, is increasingly critical of a policy that appears to provide Israeli leadership with a blank check. The 2024 presidential election cycle has brought these tensions to the forefront, with calls from some quarters to place conditions on US aid to Israel.
A shift in this policy would not mean abandoning a long-standing ally. Rather, it would mean using US leverage to encourage policies that are aligned with international law, human rights, and the long-term goal of a peaceful, two-state solution. It would mean making it clear that all states, including Israel, must be held accountable for their actions and that international institutions like the ICJ and ICC must be allowed to fulfill their mandate without undue political interference. Continued blind defense will only entangle the US deeper in a regional quagmire, further erode international law, and ultimately, undermine the long-term security of both Israel and the United States.
