Protests on September 7th and each Party's position regarding the ban on X in Brazil

This weekend there will be protests, where many will go to support the right and the extreme right and many will go to protest for X. Not necessarily for X, but for the dozens of situations that recently led to the banning of X in Brazil. Nothing is more symbolic than raising an anti-censorship flag on Brazil's Independence Day.

The September 7, 2024 demonstration will have special ingredients. It will further inflame spirits in Brazil. It seems that I am seeing the scenario of 10 years ago with the Fora Dilma demonstrations. However, the target this time is different, Alexandre de Moraes. With less rejection than the former president who was hated and harassed by almost all political spectrums, except the one to which she belonged, this time the minister has almost all of the spectrum on his side, currently the left and the center left, because not even the extreme left is accepting the attitudes of the member of the Supreme Court. However, in 2016, when he was nominated for the position, the left that defends him today, attacked him with words that were the same or worse than those used today.

Well, let's understand what each side wants on this September 7th and what each of these sides represents? I would like to attach images of tweets to this post, but unfortunately I won't be able to, after all, I live in Brazil, and at this moment, like other countries, we are prohibited from accessing it. So let's start by seeing which are some countries that prohibit X.

We can clearly see that we are in a group that is not very democratic, so to speak, even the judge who decreed such an act claims that his actions are to maintain democracy.

Then moving on to the political spectrum, we will separate them into 7 points. Obviously, the more we zoom in on the spectrums, the more points will appear, but I believe that by separating them into 7 I can give you an overview that you can understand.

Manifestações de 7 de Setembro e a posição de cada partido a respeito do banimento do X no Brasil

Nesse fim de semana haverá uma manifestação, onde muitos irão para apoiar a direita e a extrema-direita e muitos irão para protestar pelo X. Não necessariamente pelo X, mas pelas dezenas de situações que desencadearam recentemente no banimento do X no Brasil. Nada mais simbólico que levantar uma bandeira anti-censura no dia da Independência do Brasil.

A Manifestação de 7 de Setembro de 2024 terá ingredientes especiais. Irá inflar ainda mais os ânimos no Brasil. Parece que eu estou vendo o cenário de 10 anos atrás com as manifestações Fora Dilma. Porém o alvo dessa vez é outro, Alexandre de Moraes. Com menor rejeição que a ex-presidente que era odiada e hostilizada por quase todos os espectros políticos, menos aquele ao qual ela pertencia, dessa vez o ministro está com quase todo um lado do espectro do seu lado, no momento atual a esquerda e a centro esquerda, pois nem a extrema-esquerda está aceitando as atitudes do membro do Supremo. Porém em 2016 quando foi indicado ao cargo a esquerda que hoje o defende, o hostilizava com palavras iguais ou piores que as ditas atualmente.

Bom, vamos entender então o que cada lado quer nesse 7 de Setembro e o que cada um desses lados representam? Eu gostaria de anexar imagens de tweets nessa publicação, mas infelizmente não poderei, afinal eu moro no Brasil, e nesse momento a exemplo de outros países estamos proibidos de acessar. Então vamos começar vendo quais são alguns países que proíbem o X.

Podemos ver claramente que estamos em um grupo não muito democrático, assim dizendo, mesmo o juiz que decretou tal ato alegando que suas atitudes são para manter a democracia.

Indo então para o espectro político vamos separa-los em 7 pontos. Obviamente quando mais dermos zoom nos espectros mais pontos irão aparecer, mas acredito que separando em 7 consigo passar um panorama que vocês consigam entender.

A tabela abaixo mostra os espectros e os partidos que estão contrário ou favorável ao banimento do X no Brasil. Atualmente temos 29 partidos registrados no Brasil, e você só pode concorrer a eleição se estiver filiado a algum deles.

The problem started long before Musk entered the scene. Here are some points to bring you up to speed on what's happening:

i) It doesn't seem appropriate to read Minister Alexandre's decision in isolation. It's part of something bigger that has been going on since 2021, with the "digital militias inquiry";

ii) The existence of this inquiry itself was questionable. The way it was conducted - with resistance to the participation of the Public Prosecutor's Office; with the replacement of the Public Prosecutor's Office by ex officio acts; with the conjunction of functions in the same figure; with the confidential proceedings; with the denial of access to the defense; with the apparent infinity of the investigation; the issue of the Supreme Court becoming a universal court; the issue of the Supreme Court's jurisprudence wavering every other day on the definition of the scope of protection of the right to freedom of expression - end up generating even more questionable. This is because they would be elements easily remedied or explained;

iii) No one in Brazil seems to seriously argue that Elon Musk or Twitter are above the law. Indeed, Twitter needs a representative in the national territory - but is it the competence of the Supreme Court to analyze the existence or not of a representative? It seems to me not. Another act that could be remedied with other measures;

iv) The Supreme Court coming to Twitter to promote the summons of the platform, within the platform itself, and summon someone who does not legally represent the platform is another act that seems to be "playing to the crowd". The Supreme Court is not a game of audience, procedures should serve for something other than demoralizing the platform;

v) The Superior Electoral Court coming to Twitter, after the order to suspend the platform, and communicating through it represents a bit of an absurdity. It is somewhat reminiscent of the episode narrated by Stanislaw Ponte Preta "Arrest Sophocles". In fact, Brazil has once again become a big FEBEAPÁ;

To give you context about this reference, since you're not from Brazil:

Febeapá is a book whose title letters stand for - The Festival of Nonsense that Plagues the Country. In this book there is a short story by Stanislaw in which he portrays a situation from the 60s, the time of the Military Dictatorship in Brazil where a censor, after watching a play inspired by Sophocles' Electra, invaded the rehearsal of the play the next day to order the arrest of Sophocles because he found the content of that show absurd, and then he was informed that the author had already died more than 2400 years ago.

vi) Is Twitter's resistance to comply with the monocratic decisions of Minister Alexandre lawful? No. Are Minister Alexandre's decisions lawful? It also seems to me that they are not. But to conclude this we need to go back to understanding what is effectively the scope of protection of freedom of expression in a country that has never had much appreciation for the rule of law;

vii) The discussion Minister Alexandre vs. Musk has long since moved away from an institutional issue. It has the contours of a personal arm wrestling match in which the Supreme Court's decision simply represents anachronism: it serves no purpose. Those who liked Twitter still use it with VPN. We still replicate tweets in prints but now we take the trouble to put a disclaimer (I didn't access via VPN, I received the print from a third party). This is serious. The Court gains nothing. It does not give effectiveness to its decision and still comes out as an enemy of freedom of expression. It shows how unprepared we are to face the digital world;

viii) Still in the inquiry - regarding which we do not know how many investigated it contains, what evidence it produced, what it investigates, because it is under secrecy - the disregard of legal personality was determined, justified by an economic group in the Twitter-Starlink-Elon Musk triad. Another procedure that is absolutely atypical and whose basis is quite scarce. But again, it came to nothing. The satellites are not under Brazilian jurisdiction. Neither is the provision of internet (are we going to block the signal?). Much less the provision of content through this internet service. So we take a provider that represents 0.4% of the market and make it simply have the ability to demonstrate the Brazilian Justice system as a dinosaur;

ix) The whole issue seems to serve more as a smokescreen. After all, two weeks ago our discussion was the leak of information from Minister Alexandre's office about possible illicit (and ex officio) proceedings in the search for pretexts for removing content. An inquiry was also opened here. The rapporteur of this inquiry? Yes, him, Minister Alexandre. And we now ignore something that, if proven, has even more serious contours than the collusion of Operation Car Wash.

Also for your reference, since you're not from Brazil, Operation Car Wash was an operation that uncovered several corruption scandals, including the one that led the current president of Brazil to be imprisoned for more than 1 year, in which it was detected that the judge and the prosecutor were colluding, with the judge guiding the prosecutor on how to proceed in the case so that the defendant would be convicted.

x) In the end, I think democracy dies in darkness. Blocking accounts, demonstrations, hiding decisions, evidence, requests is absolutely atypical. Transparency is non-negotiable.

Concordo contigo, muita coisa eu mudaria na lista, para mim PSOL é extrema-esquerda. Em um Diagrama de Nolan o novo estaria mais próximo de libertário do que da direita. Porém coloquei baseado no que estavam na Wikipedia. Sei que não é a melhor fonte, kkk, mas é o que deu pra fazer de mais imparcial.

Na verdade o número de partidos é o menor dos problemas, por mim poderia ter 100 partidos, se também houvesse a possibilidade de se candidatar sem ser necessário estar filiado a um partido. Isso resolveria muitos problemas.
