Our liberties, and indeed many Western liberties, were enshrined in English common law long before government came along with legislation to control us. As soon as government got into the driving seat they got to work almost immediately eroding our liberties by passing Act after Act.
Government was never created to protect our liberties. Prior to the inception of government the people through common law and custom law were did pretty well to look after themselves, albeit with some exceptions. But on the whole their communities lived to the fullest means possible at that time and they lived mostly in harmony.
